Will the ACA Result in Fewer Workers' Compensation Claims?

The American employer’s role as health insurance provider has slowly evolved along two paths, workers’ compensation and employee benefits. The 2010 enactment of the Patient Protection and Affordable Care Act (“ACA”) cements this concept: Americans’ healthcare largely rests with employers.

Such a development begs the question: will the ACA result in fewer workers’ compensation claims? Certainly it is too early to know, but probably not. Although private health insurance and workers’ compensation both provide treatment, private health insurance comes with deductibles and co-pays, and offers no chance for indemnity. As such, when faced with these two potential sources of healthcare, most employees will likely choose workers’ compensation.
